Your benefit amount is based on your average lifetime earnings – or possibly those of certain family members – that are insured under Social Security. If you receive money from other sources, such as workers’ compensation or a pension based on earnings not insured by Social Security, your benefit may be lower.
And, contrary to what some people believe, the severity of your condition does not affect how much you will get.
Of course, there’s a lengthy process to undertake before you even get benefits. First, you have to fill out the long application and provide medical proof about how your condition affects your ability to work.
Then you have to wait for the Social Security Administration to get back to you. And when it does, there’s a good chance that you will have been turned down. About two-thirds of applicants – even those who should get benefits – are turned down.
The good news is that help navigating the confusing and frustrating Social Security Disability system is available. Experienced and knowledgeable legal professionals can help guide you through the process.

The Social Security Disability trust fund was established to provide you with monetary assistance if you cannot work due to a disability. You must have worked long enough while paying into Social Security in order to get benefits. However, if you are the surviving spouse of a Social Security Disability recipient, you may qualify for benefits regardless of your work history.
As the widow or widower of a disabled worker, you can:
- Receive full benefits at full retirement age for survivors or reduced benefits as early as age 60.
- Start getting benefits as early as age 50 if you are disabled and the disability began before or within seven years of your spouse’s death.
- Receive survivors’ benefits at any age if you are taking care of your deceased spouse’s child who is under 16 or is disabled and getting benefits.
This can all be rather complicated, so it would be a smart move to talk to an attorney. If you live in Chicago, the knowledgeable Social Security Disability benefits attorneys at the Disparti Law Group can work with you to help get the benefits you need.
Completing the application and gathering all the necessary medical forms and documents can be a long and tedious process, particularly when you have a disability. But we will make sure that your case is handled properly from the start.

With Tax Day quickly approaching, people have a lot of questions about taxable income and the amount of taxes they will have to pay. One issue that often arises regards taxes on Social Security benefits.
According to the Social Security Administration, you have to pay federal taxes on your Social Security benefits if you file a federal tax return as an individual and your total income is greater than $25,000. If you are filing a joint return, you will have to pay taxes if you and your spouse have an income of more than $32,000.
Social Security does not have the authority to withhold state or local taxes from your benefits, and many states and local vicinities do not tax these benefits.
When you have questions about taxes or anything else related to Social Security Disability benefits, you should talk to people highly experienced with the system. If you live in the Chicago area, the Illinois disability benefits attorneys at Disparti Law Group can answer your questions about Social Security Disability.
If you are planning to apply for Social Security Disability benefits, we can assist you with the application and with gathering all required medical forms and documents. While you concentrate on your health, let us deal with all the governmental rules and regulations.

Many people wonder how the sequester – or automatic federal spending cuts – will affect them. A lot of people are concerned about Social Security and particularly the disability component.
Social Security benefits under the retirement and disability programs are exempt from cuts. However, the Social Security Administration, which administers benefits, is not exempt.
The White House said that the sequester in regards to Social Security means “a reduction in service hours to the public, and a substantial growth in the backlog of Social Security disability claims.”
It is certainly nice to hear that benefits will not be cut, but it is disheartening that the already large backlog of disability claims could grow. Still, if you have been thinking about applying for Social Security Disability benefits, you should not let this news stop you.
Hiring an experienced Social Security Disability benefits attorney will help ensure that your application is considered as promptly as possible. If you live in Illinois, the Chicago area Social Security Disability benefits lawyers of Disparti Law Group will work to get you the benefits you deserve. Thanks to a new grant by the U.S. Department of Housing and Urban Development, Illinois will soon be able to offer more affordable homes to people with disabilities. The state is getting $11.98 million, which equates to 825 houses.
“Investing in people is the most important thing we can do,” Progress Illinois quoted Gov. Pat Quinn as saying. “We’re committed to making sure all our citizens – regardless of the challenges they face – have the opportunity to reach their full potential.”
The grant will allow the Illinois Housing Development Authority to give qualified owners five-year rental subsidies that are renewable for up to 20 years.
“These resources will not only help us provide a home for people who need one, but also the skills training, counseling and services they need to become productive members of their communities,” Quinn said.
This is excellent news for disabled Illinois residents with low incomes.
If you are too sick or injured to work, you should consider applying for Social Security Disability benefits. The average benefit amount is not terribly large, but it is enough to improve the lives of recipients

Treasury Secretary Timothy Geithner is urging Congress to extend borrowing authority for the U.S. debt in order to keep programs such as Medicare, Medicaid and Social Security Disability out of danger.
Currently the government makes about 80 million payments a month for these programs as well as veterans’ benefits and defense contractors.
“If Congress does not act to extend borrowing authority, all of these payments would be at risk,” Geithner said. “This would impose severe economic hardship on millions of individuals and businesses across the country.”
Geithner is optimistic, however, noting that there has never been a Congress that hasn’t met its responsibility of “protecting the full faith and credit of the United States.”
Regardless of what happens in the future, Social Security Disability continues to help million of Americans. If you are too sick or injured to work, you shouldn’t hesitate to apply for benefits.

Approximately 65 percent of people who apply for Social Security Disability benefits are rejected on their first try. This includes many individuals who deserve benefits but nonetheless are turned down at first.
This is in part because the Social Security Administration receives so many applications and has such a large backlog. When applying, you need to make sure that your application is completely filled out without any errors and that all the proper medical forms are included.
You can do this on your own, but to give your claim the best chance for approval, you should hire an experienced Social Security Disability attorney.

If you are receiving Social Security Disability, your case will be reviewed periodically. The Social Security Administration is required to review cases to make sure people getting benefits are still too disabled to work.
So what does this review entail? First, the SSA will obtain any new information regarding your condition. It will contact your doctor and any other sources for your medical records.
Your doctors and other sources will be asked how your condition limits your activities, what your tests show, and what treatments you have been given. If more information is needed, you will have to go for a free medical exam.
The SSA will look at your medical condition when your case was last reviewed as well as any new health problems you may have. It will then decide whether your condition has improved and whether you can return to work. If SSA determines that you can work, your benefits will stop.
However, if you disagree with that conclusion, you do have options. Your best course of action would be to hire a Social Security Disability lawyer and appeal the decision.
